If you do not agree with any part of these terms, please discontinue use of our website and services.
2. Agency Services & Deliverables
Gundrux provides digital agency services specified in individual client proposals, agreements, or platform contracts (such as Fiverr and Upwork). While we apply proven SEO practices and automation strategies, search engine algorithms (Google, ChatGPT, Perplexity) and third-party platform rules fluctuate. We do not guarantee specific fixed ranking positions or third-party platform policy changes outside our control.
3. Client Responsibilities
Clients agree to provide timely access to necessary assets, credentials (e.g., WordPress admin, Google Search Console, API keys), and feedback required for project execution. Delays in asset submission by the client may extend agreed project completion timelines.
4. Payments & Refunds
Payment terms are outlined prior to project commencement via direct invoices, project milestone agreements, or platform billing (Upwork/Fiverr). Custom project deposits or retainer fees are non-refundable once strategy work or technical development has commenced, except as explicitly agreed in writing.
5. Intellectual Property Rights
Upon full payment of project invoices, clients retain ownership of custom deliverables created specifically for them (e.g., custom website code, created media content, and branding materials). Gundrux retains rights to underlying agency frameworks, custom reusable scripts, and proprietary automation templates.
6. Third-Party Services & Integrations
Our automation systems may integrate third-party tools such as n8n, Make.com, OpenAI/Claude APIs, YouTube, or hosting providers. Clients are responsible for maintaining active API keys and subscriptions for third-party platforms required to run their custom workflows unless managed under an active retainer.
7. Limitation of Liability
In no event shall Gundrux or its team be liable for indirect, incidental, or consequential damages resulting from website downtime, search algorithm updates, third-party platform bans, or loss of business data. Our total liability is limited to the fees paid by the client for the specific service rendered.
8. Governing Law & Jurisdiction
These terms are governed by and construed in accordance with the laws of India. Any legal disputes arising out of or in connection with our website or services shall be subject to the jurisdiction of the courts in Guwahati, Assam, India.
